Two different legal categories of homicide are manslaughter and first and second degree murder. The charge manslaughter is for instances where the accused didn't plan the crime. The acused did not have intend to kill the victim by their actions. First degree degree murder on the other hand is when the accused killed with malice and second degree is when the accused killed with passion.
