Claude, a creditor seeking to collect a debt, calls on Dianne and demands payment in a rude and insolent manner. When Dianne says that she cannot pay, Claude calls Dianne a deadbeat and says that he will never trust Dianne again. Is Claude liable to Dianne? If so, for what tort? Explain.

    No. Claude is not liable to Dianne.

    Explanation:

    AS a creditor, Claude has the right to a specific amount of money that previously agreed upon with Dianne. Which means that Dianne is the one that liable to Claude since she can't pay the amount that she agreed to pay.

    The problem in this context probably arise due to Claude's rude behavior.

    The United States' law only provide protection for the debtor if the creditor actually did something that caused some sort of harm to the debtor. There are no law that necessarily prevented someone from being rude.
