Dred Scott was a slave, owner existed with him in Illinois and Wisconsin territory (free) for some years, supposed this made him a free man, jury ruled in his favor, Missouri supreme court overturned the decision on the grounds that slaves could not have a right to a trial or to testify on his behalf, court also ruled that Missouri compromise was illegal and captivity could not be banned in a territory, slaves were property, fifth amendment guaranteed rights to property.
