    The Fifth Amendment establishes a series of guarantees within the criminal process in favor of the accused. Thus, defendants are protected from testifying against themselves and being doubly persecuted for the same act (double-jeopardy prohibition). This amendment also establishes that any process whose penalty is the death penalty must be carried out before a Grand Jury, and that no penalty will be brought without due process of law (due process clause). Finally, the amendment also states that private property cannot be unfairly occupied without compensation.
