The case was involved with affirmative action. Affirmative action is a set of laws, policy and guidelines in the United States of America which is intended to end and correct the affects of a specific form of discrimination. Different kind of racial quota is also included in the activities of affirmative action.

    However Bakke was an engineer and a former US Marine corps sought admission in medical school. But he was rejected from two places because of he was too aged. He was at his early 30s. When University of California, Davis rejected him twice, he filed a law suit against the affirmative program run by schools and challenged the constitutional legality of the program.

    So the case is involved with the affirmative action program.
