The former Illinois congressman reached Washington by secret route to avoid danger, and his movements were monitored by General Winfield Scott's forces. Davis spoke at the Alabama Capitol of Montgomery about the merits of the new constitution, which he said was in accordance with the 1787 Constitution written in Philadelphia and in accordance with the Declaration of Independence. He argued that following federal government actions, federal states had no choice but to create their own constitution.
