If the government wants to take land to build a highway, the Fifth Amendment says that the affected property owners must be compensated for the land. be imprisoned if they object. defend their land rights in court. surrender the land as part of their patriotic duty.

    This legal action is formally known as Eminent Domain which is the power of the government to take private land only and specifically for public use

    The law of eminent domain derives from the so called Takings Clause which states that no private property will be taken without "just compensation"

    When the government takes private property for public use, it must fairly compensate the owner for the deprivation at a reasonable price for which the landowner expects to sell the property.

    Just Compensation which is determined using the market value of the land depending on if it is a permanent or a temporal taking.
