Why did the court allow Alvarado's confession to be used as evidence?

    Alvarado's attorney believed that his confession should not be used because he had not been read his Miranda Rights. What made his confession be used as an evidence was actually the fact that he was not in custody at the time of the confession, invalidating what his attorney wanted. Alvarado was eventually convicted of 2nd degree murder.
