What document did justice black criticize as part of his argument in the dissent

It was due process. He believed that it covered too much scope. For him, it denies Congress the ability to make laws on the basis of their judgment and this is given to the courts. He wanted a more limited definition of due process which many of his co-judges did not agree with.
