All arrested persons must by law be notified of their rights in order for the arrest to be legal.

    Yes but if said officer forgets to read the suspects Miranda rights the prosecutor would not be able to use anything the suspect may say for evidence purposes but if the officer had forgotten to read the suspects rights it does not grant the suspect freedom.
