I believe the answer is: The court will dismiss the case because Mary lacks standing to sue

There are several reasons for mary's lack of standing. The first one that she has no way to proof whether her accusations is true or not. Second, unless the captain in that situation purposedly put the troops in danger, his action would be considered as the expense of war even if his decision is resulted in bad outcomes.
