The Supreme Court's duty is to uphold the Constitution's written rights in order to ensure the fair treatment of American citizens and justice towards all. They do this by checking power with the other 2 branches in order to keep a balance in the bureaucracy, however they also take part in court-cases when deemed fit. For example, Gideon v. Wainwright in 1963 was a Supreme Court landmark case that argued the unconstitutionality of Gideon not being assigned an attorney by the state, since the 6th amendment calls for a speedy trial, right to a jury, and an attorney if the accused is to need one. In general, although it takes time to reach the Supreme Court, if an issue is truly unconstitutional then it will be evaluated and solved by the U. S. Supreme Court.
